OpenAI is facing a new lawsuit alleging its ChatGPT chatbot failed to prevent a user’s suicide, despite the company’s claims that its latest model includes robust safety features.

The lawsuit was filed by Stephanie Gray, whose 40-year-old son, Austin Gordon, died by suicide in late October or early November. The death occurred roughly two weeks after OpenAI CEO Sam Altman posted on X on Oct. 14 that the GPT-4o model was safe and had "mitigated serious mental health issues."

The GPT-4o model was designed to interact with users as a close confidant. However, Jay Edelson, an attorney representing the Raine family, said Gordon’s death proves ChatGPT remains "an unsafe product."
